Promotion terms and conditions

1. The Promoter is Honda Australia Pty Ltd ABN 66 004 759 611, 95 Sharps Road, Tullamarine, Victoria, 3043 (Promoter).

2. The name of the Promotion is “Honda invites you for a chance to win one of 2 X $50 Ampol fuel vouchers” (Promotion).

Eligibility

3. To be eligible to enter the Promotion, you must:

a. be an Australian resident;
b. be aged 18 years or over;
c. comply with these terms and conditions

(Eligible Entrant).

4. Directors, management, officers and employees (and their immediate families) of the Promoter are not eligible to enter the Promotion.

5. Promotion Period: From 12am (AEST) on 3/10/2023 to 11:59pm (AEDT) on 12/10/2023.

Entries

6. To enter, you must complete the following during the Promotion Period:

a. Receive the survey sent by the Promoter via email;
b. Complete the survey, including by providing all required contact information,

(Eligible Entry).

7. Your entry will be deemed to be received at the time it is received by the Promoter. Entries received outside of the Promotion Period will only be included in the Promotion at the Promoter’s sole discretion.

8. You may only submit one entry during the Promotion Period. Any subsequent entries will be excluded.

9. The Promoter reserves the right to disqualify a Winner if the Promoter becomes aware that the Prize Winner and/or the Prize Winner’s entry does not comply with these Terms and Conditions.

Prize and Determination

10. There are two Prizes available.

11. Each Prize is a $50 Ampol fuel voucher (Prize). The fuel vouchers will have their own terms of use applicable to them.

12. The total prize pool value is $100.

13. A prize draw will occur at 12pm (AEDT) on 16/10/2023 at CIE Legal, Level 28, 2 Southbank Boulevard, Southbank Vic 3006.

14. The first two Eligible Entries drawn will be deemed the winning entries, and the Eligible Entrants corresponding to these entries (Winners) will be awarded the Prize.

15. The Promoter may draw additional entries and record the entrant for each, in order, to be considered in case a Winner is later deemed to not be an Eligible Entrant (Reserve Winners).

16. If you are a Winner, you will be notified by phone and in writing within 7 days of determination. Your name will also be published on the Promoter’s website [https://www.honda.com.au/competition] on 23 October 2023 and remain visible for a period of no less than 28 days.

17. You must claim the Prize within 14 days of being notified by the Promoter (Claim Period).

18. If you do not accept the Prize for any reason during the Claim Period, despite every reasonable effort taken by the Promoter to contact you, the Promoter will conduct another electronic draw (Redraw) to determine the Winner. Once the Claim Period ends, you will no longer be deemed the Winner.

19. The Redraw will be conducted at 12pm (AEDT) on 8 November 2023 at CIE Legal, Level 28, 2 Southbank Boulevard, Southbank Vic 3006. The Redraw and rules for claiming the Prize will be conducted in the same manner as set out in paragraphs 14 to 18.

20. If you are the Winner of the Redraw, the Promoter will notify you by phone and in writing within 7 days of determination. You must claim the Prize within 14 days of being notified by the Promoter. Your name will also be published on the Promoter’s website [https://www.honda.com.au/competition] on 15 November 2023. Any Prize that has not been won or claimed at the end of this period will be forfeited.

General Conditions

21. The Promoter reserves the right to require you to verify the validity of your entry within a time specified by the Promoter, including but not limited to your identity, eligibility, age, address and to disqualify any entrant who does not satisfy any entry criteria in these terms and conditions. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. Errors and omissions may be accepted at the Promoter’s sole discretion. Proof considered suitable for verification is at the Promoter’s discretion.

22. You are required to take full responsibility for the entry content and for ensuring that the entry content complies with these terms and conditions. “Entry content” includes any content that you submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion.

23. The use of automatic entry software, mechanical or electronic devices that allows an entrant to automatically enter the Promotion is prohibited and may render all entries submitted by that entrant invalid.

24. Incomplete, indecipherable, incomprehensible or inappropriate entries will be deemed invalid. The Promoter takes no responsibility for late, lost, incomplete, indecipherable or incorrectly submitted, misdirected or invalid entries, delays or failures in any equipment or telecommunications service used to administer this Promotion.

25. The Promoter may, in its absolute discretion, declare an entry invalid or disqualify any entrant that tampers with the entry process or benefits from such tampering, submits an entry that is incomplete, inappropriate or not in accordance with these terms and conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of this Promotion.

26. If you are a Winner but do not claim the Prize (or otherwise forfeit the Prize), the Promoter may still use your entry in accordance with these terms and conditions.

27. It is a condition of accepting the Prize that you must comply with all the conditions of use of the Prize and the Prize supplier’s requirements, even if not expressly stated in these terms and conditions. If you do not comply with the Promoter’s or Prize supplier’s requirements, your eligibility for the Prize may be withdrawn and the Promoter and Prize supplier will not be liable as a result.
28. If you are the Winner, you may be required to prove your identity to the Promoter’s satisfaction by providing any signed documents and identification requested by the Promoter. The Prize may not be awarded if your identity or the legitimacy or your entry cannot be confirmed.

29. The prize or any element of the Prize must be taken in whole and is not transferable, exchangeable or redeemable for cash. Prize values are in Australian dollars and are correct at the time of drafting. The Promoter accepts no responsibility for any variation in the value of the Prize.
30. If any part of the Prize is unavailable for any reason, the Promoter reserves the right to forfeit or substitute that part with another prize of equal or greater value in its own discretion, subject to any applicable law or regulation.

31. You will not be charged an administrative or delivery fee for the Prize. However, any additional costs applicable to the collection and use of the Prize that are not expressly stated in these terms and conditions will be your sole responsibility.

32. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

33. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of administering this Promotion (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a Prize.

34. All of the Promoter's decisions in relation to all aspects of this Promotion are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

35. By entering the Promotion, you agree to transfer to the Promoter ownership, including moral rights or any other intellectual property or proprietary rights, it may have in your entry. You acknowledge and agree that neither you nor any third party shall be entitled to any fee, royalty or other consideration in respect of such transfer of ownership.

36. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), as well as any other applicable implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

37. The Promoter, its associated companies and agencies and any of their personnel exclude all liability, except for any liability that cannot be excluded including the Non-Excludable Guarantees, for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by the Prize Winner or Companion in connection with the Promotion, or the Prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death.

38. The Promoter assumes no responsibility for any tax consequences related to the collection or use of the Prize. It is your responsibility to seek independent financial advice in relation to the Prize.

39. This Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc. and Entrants expressly release Facebook, Inc. for any loss or damage suffered as a result of participating in the Promotion.

40. The Promoter may acquire your personal information directly or through its agents and contractors, for the purposes of conducting the Promotion, promoting its goods or services and/or marketing purposes. Your personal information may be disclosed by the Promoter to its related companies, contractors and agents to assist in conducting the Promotion, storing data, supplying the Prize or communicating with you. Some of these third parties may be located overseas.

41. If you do not provide the personal information the Promoter requests, the Promoter may not be able to provide entry into the Promotion and you may not be able to receive the Prize. All personal information is handled in accordance with these terms and conditions, the Promoter’s Privacy Statement and the Promoter’s Privacy Policy.
